This bill affirms that mandated leave expired on 12/31/2020. However, if your business was previously covered under the FFCRA mandate (even if you chose to opt out at the time due to being a healthcare provider or small employer), you can opt back into one or both of the programs and continue receiving tax credits. You may also opt out of one or both of the programs at any time; however you should not do so in a discriminatory manner.
