- FMLA Rights & Responsibilities must be posted and must be provided to employee along with a notice of eligibility (unless using standard Notice of Eligibility form).
- WH-381 Eligibility Notice must be sent to an employee within 5 business days of a request for leave, letting the employee know of their eligibility (or ineligibility for FMLA). It includes rights and responsibilities and a request for more information and/or certification.
- WH-382 Designation Form is sent to an employee after an employee’s certification forms have been reviewed to approve/not approve or request additional supporting information related to a request for FMLA leave and must be sent after reviewing certification information.
- Certification Forms are normally sent out with form WH-381. There are different forms depending on the reason for leave. After clicking on link, scroll down to the certification forms heading.
