Pregnant Workers Fairness Act in Effect + New Mandatory EEO Poster

On June 27, 2023, the Pregnant Workers Fairness Act (PWFA) went into effect. The PWFA requires employers with 15 or more employees to engage in an interactive process to determine if they can make reasonable workplace accommodation(s) related to pregnancy and childbirth. This law applies to both employees and applicants. The EEOC has an updated resource,  What You Should Know About the Pregnant Workers Fairness Act 

Effective immediately, employers must post the new EEOC “Know Your Rights: Workplace Discrimination is Illegal” Poster. This new poster includes updated language to comply with the PWFA. 

As a reminder, there is also a new mandatory FLSA poster to reflect updated language around the new PUMP Act. In addition, there is an optional updated FMLA poster available. Note the April 2016 and February 2013 versions still fulfill the posting requirement.

In 2020, the DOL issued Field Assistance Bulletin 2020-7 to provide guidance on acceptable electronic distribution of employment posters. The guidance states electronic versions of employment posters are acceptable if: 

  • Employees regularly receive communication electronically and, 
  • Employees always have readily available access to the posters.
