The standard tightened in August 2023, when the POWR Act (SB 23-172) removed the old severe-or-pervasive test, so unwelcome conduct based on a protected class can now be unlawful harassment well before it becomes extreme. Colorado employers also generated 1,290 EEOC charge receipts in fiscal year 2025 (EEOC Table E1b, FY 2025, retrieved 2026-07-27), on top of state filings. Under the federal Faragher and Ellerth decisions, a genuine policy plus documented supervisor training gives an employer an affirmative defense to supervisor harassment claims.
